Terms and Conditions for Vibes

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Vibes mobile application (the "Service") operated by Vibes ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. The Service: Anonymous Vibe Sharing

Vibes is designed to be an anonymous platform. We do not require users to create profiles, and we do not store personally identifiable information associated with the content you post. The Service allows users to share short, temporary, text-based "Vibes" that are visible to a local or defined community for a limited time.

• Anonymity: While we strive to maintain your anonymity, no system is completely immune to security breaches. Users should exercise caution and avoid posting information that could directly or indirectly identify them. You acknowledge and agree that your anonymity is not guaranteed.
• Data Retention: Vibes are temporary and are designed to be automatically deleted from our servers after a short, defined period (e.g., 24 hours). We reserve the right to delete content at any time for any reason.

2. User Conduct and Content

You are solely responsible for all content, including text, images, or other materials, that you post, upload, link to, or otherwise make available via the Service ("Content").

Prohibited Content and Actions:

You agree not to use the Service to:

• Post illegal content: Any Content that is illegal, incites illegal acts, or violates any applicable local, state, national, or international law or regulation.
• Harassment and Hate Speech: Post content that is threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or hateful toward a person or group based on race, gender, sexual orientation, religion, ethnicity, or disability.
• Doxxing/Identification: Attempt to discover, solicit, or share the private or personally identifiable information of any other individual (including yourself). The Service is for anonymous vibes, not personal attacks or identification.
• Impersonation: Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Spam and Commercial Use: Upload, post, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation.
• Self-Harm/Suicide: Post content that encourages or provides instruction on self-harm, suicide, or violence. If you or someone you know is in immediate danger, please contact emergency services immediately.
• Malicious Software: Upload or transmit files that contain viruses, worms, Trojan horses, or any other destructive features that affect the operation of the Service.

Our Right to Moderate:

We have the right, but not the obligation, to monitor, edit, or remove Content that we determine, in our sole discretion, is in violation of these Terms or is otherwise harmful.

3. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Vibes and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Vibes.

Your Content License: By posting Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Content in connection with the Service. This license is necessary for us to operate and provide the Service.

4. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Limitation of Liability

In no event shall Vibes, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• your access to or use of or inability to access or use the Service;
• any conduct or content of any third party on the Service;
• any content obtained from the Service; and
• unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of [State/Country where your company is registered], without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
